NotesFirst, Inc. (“NotesFirst”) has created this Privacy Policy in order to demonstrate its commitment to privacy. We recognize that the visitors to the NotesFirst website (the “NotesFirst Service”) and subscribers and other users of the NotesFirst service for note taking, managing tasks and sharing data (the “NotesFirst Service”) care how their information is used and shared. This Privacy Policy describes the types of personal information collected, how the information is used, and the safeguards in place to protect that information.

NotesFirst may update this policy from time to time. The effective date noted below indicates the date that this policy was last updated. Each visitor to the NotesFirst Site or subscriber to the NotesFirst Service is responsible for checking this Privacy Policy periodically for changes.

WHAT INFORMATION IS COLLECTED AND STORED?
NotesFirst may collect and store certain information automatically whenever you access NotesFirst Site. The amount and type of information NotesFirst collects depends upon your use of the NotesFirst Site. A non-subscriber may browse the NotesFirst Site without providing personal information. NotesFirst passively collects information that is automatically sent by your web browser. This information typically includes your domain name. It may also contain additional information. The amount of information sent depends on the settings you have on your web browser. Each time you come to the NotesFirst Site, NotesFirst may count, track and aggregate the visitor’s activity for analysis of general traffic flows at the NotesFirst Site. This information is used to improve this NotesFirst Service and to provide you with an improved on-line experience.

NotesFirst also collects personal identifying information about subscribers to the NotesFirst Service in connection with both the registration process and use of the NotesFirst Service. This information includes names, street addresses, email addresses, telephone numbers, billing, payment, usage, credit card and transaction information, as well as demographic information. NotesFirst uses this information to manage your subscriber account, including to process transactions through your account.

USE OF COOKIES
NotesFirst may use “cookies”, which are files stored on your computer’s hard drive by the browser. These cookies help NotesFirst to (i) identify and authenticate visitors and subscribers, (ii) store preferences, (iii) tailor content and advertisements on the NotesFirst Site and NotesFirst Service according to user preferences, (iv) preserve session settings and state, (v) automatically fill in forms and sign-in screens, and (vi) analyze the performance of the NotesFirst Service. The cookie does not contain any personally identifiable information but does identify the specific installed program you use to browse the NotesFirst Site. Most browsers accept cookies automatically but allow a user to disable them. If cookies are disabled, you may not be able to take full advantage of a personalized experience on the NotesFirst Site.

IS INFORMATION SHARED WITH THIRD PARTIES?
NotesFirst does not sell to others any personal information that may be provided to NotesFirst through the NotesFirst Site, unless it is with consent as otherwise described in this Privacy Policy. NotesFirst does not share personally identifiable information with third parties except for NotesFirst’s suppliers, business associates or service providers with whom it has a written agreement providing for the same level of protection as provided by NotesFirst under this Privacy Policy. If a third party acquires substantially all of NotesFirst’s assets, personal information may be included in the assets transferred as part of that sale.

HOW IS THIS INFORMATION USED BY NOTESFIRST?
NotesFirst may use personal information for the following purposes:

  • Contact information for potential clients or persons seeking information is collected in order to enable NotesFirst to contact those persons to provide information about NotesFirst’s products and services. This information may be stored on NotesFirst servers in the United States.
  • Contact information, such as your name, address, telephone number, or email address, submitted by existing customers, is used to provide additional information regarding the NotesFirst Service or other products and services, including new features, functionality, new products and services that NotesFirst may introduce from time to time, upcoming events, and new features of the NotesFirst Site.
  • General administration of the NotesFirst Service and, if applicable, your user account, including processing registrations and payments and providing customer support.
  • Responding to inquiries and communications about the NotesFirst Site or NotesFirst Service.
  • Safeguarding and protecting the rights of our other subscribers and other third parties and the User Data (as that term is defined below).

NotesFirst may release personal information if (i) it believes in good faith that it is required by law or legal process; (ii) it is required by a law enforcement agency that has provided a valid request; (iii) it is necessary to enforce our Terms of Use applicable to the NotesFirst Service and the NotesFirst Site; or (iv) it is required to protect our rights or such release is necessary to protect the rights, property or safety of NotesFirst, its customers or others.

In addition, we may use non-personally identifiable information for any purpose not prohibited by law, including aggregating such information which may be provided to advertisers or other partners or used for general business purposes.

POLICY REGARDING USER DATA
The NotesFirst Service can be used to store, and possibly to share, personally identifiable information about third parties (“User Data”). User Data may include health information which is subject to laws and regulations governing its use and disclosure, including the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”). Although such User Data may be stored on your behalf as part of your use of the NotesFirst Service, NotesFirst itself will only have access to personally identifiable information in its encrypted form and does not hold or have access to any encryption keys. Because you may use the NotesFirst Service to share User Data with others, you are solely responsible for any actions taken by such persons to whom you have granted access, and this Privacy Policy does not cover those activities. You agree to at all times comply with HIPAA or any other applicable laws and regulations with regard to your collection, storage and use of User Data.

LINKS
The NotesFirst Site and the NotesFirst Service may contain links to other websites. NotesFirst is not responsible for the privacy policies applicable to other websites or how they may treat information about their users. Advertisers on the NotesFirst Site, or other websites to which you link, may have the ability to assign cookies in a process not under NotesFirst’s control.

IS INFORMATION COLLECTED FROM CHILDREN?
The NotesFirst Service and the NotesFirst Site are not suitable for use by minors. Accordingly, NotesFirst does not market to anyone who is known to NotesFirst to be under the age of 18, nor is any personal information collected from anyone who is known to NotesFirst to be under the age of 18.

OTHER CIRCUMSTANCES
From time to time, NotesFirst may sponsor promotional events which require the collection, processing and storing of individual contact and demographic information to be used for the event. NotesFirst may also co-sponsor activities with other persons or organizations, in which case individual contact and demographic information is likely to be shared with the other participating sponsors. Although NotesFirst may request that co-sponsors of such events uphold the privacy of the information, NotesFirst has no liability or responsibility where the co-sponsors do not comply with any requests by NotesFirst.

HOW CAN INFORMATION BE CORRECTED?
The NotesFirst Site provides visitors with the ability to correct information they have provided to NotesFirst through the NotesFirst Site administrator. Please send your corrections or updates to . Participants may also choose to opt out in the event NotesFirst indicates that their personal information will be disclosed to a third party or used for a purpose incompatible with the purpose for which it was originally collected or not subsequently authorized by the customer.

OPT-OUT POLICY
The default assumption is that you have “opted-in” and consented to use of your information as set forth in this Privacy Policy and in accordance with NotesFirst’s standard policies and procedures. If you no longer wish to receive information from NotesFirst, you may request that NotesFirst cease further contact at any time by sending an email request marked “Privacy-Urgent” to . We will use commercially reasonable efforts to delete such information from the database. While NotesFirst is processing your request, you may continue to receive communications from NotesFirst.

CALIFORNIA PRIVACY RIGHTS
As of January 1, 2005, California Civil Code Section 1798.83, California residents have the right to request in writing from businesses with whom they have an established business relationship, (1) a list of the categories of personal information, such as name, address, email address, and the type of services provided that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for that third parties’ direct marketing purposes, and (2) the names and addresses of all such third parties. To request the above information please send an email message to with “Request for California Privacy Information” on the subject line and in the body of your message. The requested information will be provided in response to the email address from which NotesFirst received the message.

A response to such requests will be provided within thirty (30) days following receipt at the NotesFirst email address stated above. If a request is received at a different email address, NotesFirst will respond within a reasonable period of time, but not to exceed 150 days from the date received. Please note that NotesFirst is only required to respond to each customer once per calendar year.

WHAT STEPS ARE TAKEN TO PROTECT CUSTOMER INFORMATION?
NotesFirst takes reasonable security measures to protect personal information from loss, misuse, alteration and destruction of the information under our control. NotesFirst uses reasonable industry standard procedures and processes to safeguard the confidentiality of personally identifiable information. When you submit information over the Internet, the information may travel over many systems not under NotesFirst’s control. No data transmission which is wireless or mobile or over the Internet is completely secure. Others may intercept the information you are sending. To protect personal information, you should take appropriate steps to guard their password and safeguard your system. If you become aware of any loss, theft or unauthorized use of a password, please notify NotesFirst immediately by sending an email message to support@notesfirst.com.
